BENIN CITY – The Executive Director, African Network for Environment and Economic Justice, (ANEEJ) and Human Rights Activist, Rev. David Ugolor has dragged the Inspector General of Police (IGP) before the Court of Appeal, Benin, over failure of the IGP and the Attorney-General of the Federation to comply with the order of the court directing them to pay him the judgement sum of N5 million made on May 6, 2013.
In a motion on Notice dated February 9, 2015 and filed on his behalf by Emmanuel Olayiwola Afolabi (Esq), the Human Rights activist averred that the grounds upon which his application had been made include the fact that the Appellants have failed to obey the order of the court directing them to pay the judgement sum of N5 million to the Deputy Chief Registrar who shall immediately deposit same into an interest yielding account.
He also said that the Order made on the 6th of May 2013 which the Appellants have failed to obey till date had not been set aside by Appellate Court and that the conduct of the Appellants/Respondents shows that they have no respect for the lawful order made by the court and finally that the integrity and the majesty of the court ought to be protected, as a court would not give hearing to any party who is in gross disobedience of its lawful order.
It will be recalled that on the 6th of May, 2013, the Court of Appeal in Benin, after a thorough examination of the case in which Rev. David Ugolor was allegedly implicated in the gruesome murder of Comrade Oyerinde Olaitans the Private Personal Secretary to Governor Oshiomhole, not only discharged and acquitted Rev. Ugolor of the allegations against him but also awarded a judgement cost of N5 million against the Inspector General of Police and the Attorney-General of the Federation.
According to the Affidavit supporting the motion, till date, the Appellants/Respondents have blatantly and recklessly refused to obey the said order marked Exhibit “A” despite the fact that they were given 60 days within which to comply with the order. The date for the hearing of the case is yet to be fixed.
