LAGOS – A 57-year-old businessman, Olumuyiwa Oni, yesterday appeared before a Tinubu Magistrates’ Court in Lagos, for allegedly assaulting his relative on Christmas day with an iron rod.
Oni, who resides at No. 36, Ajeshomo St., Lagos Island, is facing a two-count charge of assault and wilful damage to property.
The prosecutor, Cpl. Francisca Okere, told the court that the accused committed the offences at 6.00a.m., at his residence on December 25.
According to Okere, the accused lives in the same compound with the complainant, Olayemi Oni, who also is his relative.
She said that Olumuyiwa had an argument with Olayemi over a missing valuable in his (Olumuyiwa’s) apartment.
Okere said that angered by Olayemi’s denial of taking the valuable, Olumuyiwa picked up an iron rod and hit the complainant.
The prosecutor said that the accused also damaged Olayemi’s refrigerator, which was valued at N15,000.
According to her, the offences contravene Sections 170 and 348 of the Criminal Law of Lagos State 2011.
Olumuyiwa, however, pleaded not guilty to the charges.
Reports state that Section 348 prescribes two years imprisonment for anyone convicted of wilful damage to property while 170 provides one year jail term for assault.
The Magistrate, Mrs. A.T Omoyele, granted the accused bail in the sum of N20,000 with two sureties in like sum and adjourned the case to January 29, 2015 for mention.
