The Presidential Election Petition Court has dismissed the petition filed by Action People’s Party (APP) challenging the victory of President-Elect Bola Tinubu in the February 25 presidential election.

This followed the withdrawal of the petition, marked CA/PEPC/02/2023, by the party on Wednesday.

Counsel to APP, Obed Agu, asked the court to strike out and dismiss the suit, saying he was working on the instructions of his client.

Expectedly, counsel to Senator Tinubu, Wole Olanipekun, in a reaction said he and his client would not oppose the application for withdrawal, adding that they would also not ask for cost.

Chairman of the Panel, Justice Haruna Tsammani, subsequently dismissed the suit with no cost attached.

The APP was challenging the presidential election on the grounds of alleged non-compliance with the electoral laws as well as INEC guidelines.

Following the dismissal, the court rose to reconvene at 2pm for the Labour Party’s suit.
